Description: On March 14, 2012, plaintiff, working at a restaurant, received a phone call from his friend. Plaintiff's friend owned a store at 315 Broadway, NY, NY. Plaintiff learned his friend was being arrested for selling counterfeit merchandise, and asked plaintiff if he would come to the store and lock it for him, as the friend was being arrested and could not lock up. Plaintiff's friend informed NYPD officers his friend was coming to the store to lock it. Plaintiff left work and traveled to his friend's store.
