Description: On or about August 2, 2016, plaintiff was stopped, searched, assaulted and battered, and falsely arrested by defendants NYPD Detective Sanchez and NYPD officers Doe and Roe. The search was based on racial profiling against plaintiff, who is African American, and was done without warrant, probable cause, or any legal justification. Defendants, without cause, beat plaintiff about the head, neck, back, body, and limbs, causing him severe pain and suffering and forcing him to seek medical assistance. They then caused false statements to be made to induce prosecution being brought against plaintiff, which resulted severe emotional distress and inconvenience until such time as his case was resolved in his favor.

He went into a coma at the hospital for 5 days. Charged with Criminal Trespass in the Second Degree, Resisting Arrest, Attempted Tampering with Physical Evidence, Criminal Trespass in the Third Degree, and Unlawful Possession of Marijuana. Dismissed for failure to prosecute. An a second occasion, Plaintiff was again stopped by officers in the public housing lobby, strip searched at the 23rd precinct, and charged with Criminal Trespass in the Second Degree and Criminal Trespass in the Third Degree, later dismissed.
