Description: On February 23, 2018, plaintiff Mr. Guerrero entered a clothing store in Brooklyn as a customer. He was met by approximately 10 of the defendant police officers, including defendant Officer Logatto. Defendant Officer Logatto falsely accused Mr. Guerrero of being the manager of the store and of selling counterfeit merchandise in the store. Although Mr. Guerrero explained that he did not work at the store, Defendant Officer Logatto arrested Mr. Guerrero and transported him to the precinct. Mr. Guerrero was then held in confinement overnight. Over the next eight months, the defendant officers then prosecuted Mr. Guerrero for third degree trademark counterfeit.
