Description: On or about February 25, 2015 Plaintiff was falsely arrested and accused of crimes by PO Jeremy McGee, Det. Michael A. McCarthy, Lt. Ronald Bolte, and Det. Arthur W. Smith, who commenced a malicious prosecution against Plaintiff. Plaintiff was falsely imprisoned and criminally processed variously in a precinct, Central Booking, and correctional facilities. Plaintiff suffered indignities, ridicule, humiliation, and pecuniary damage as a result of this incident.

Description: Plaintiff, a security officer at a hospital, told the defendant lieutenants that they had to move away from a patient (a police officer) in the hospital so he could receive medical treatment. The lieutenants then forced Plaintiff into an x-ray room and locked him in there. Plaintiff filed a CCRB complaint and charges against the officers were substantiated.

Description: On August 28, 2012, Plaintiff was walking on the sidewalk. Plaintiff observed citizens and police officers and used his cell phone to videotape the public activity in the area. Defendant BOLTE approached Plaintiff, seized him, and handcuffed him. Plaintiff was arrested and charged with Disorderly Conduct and Resisting Arrest without probable cause. Plaintiff was detained until his arraignment, at which time he was released. The charges were ultimately dismissed. Defendants MICELI, BOLTE, and DOES seized Plaintiff’s cell phone, damaged it, and deleted the video Plaintiff had taken of their public activity. Defendants MICELI, BOLTE, and DOES failed to intervene to prevent their misconduct.
