Description: On June 12, 2018, police officers Evans Bellavoix, UC 319, and Edwin Martinez improperly searched and seized Stephen Brown at Washington Square Park without a justifiable cause of doing so. Brown was grabbed and tightly handcuffed. While being detained, Brown was subject to excessive force including being slammed against a wall. The officers then maliciously prosecuted Brown despite knowing his innocence, continued to provide false statements intentionally, and withheld evidence that likely supported Brown's innocence. Description: On August 17, 2017, Plaintiff Herrera was approached at the Bowery Men’s Shelter Kenton Hall by undercover police officer UC00084 and asked about purchasing illicit illegal substances. Herrera, a homeless resident of the shelter, responded in the negative, knowing nothing about such transactions and exited the interaction. The next time he exited the shelter, Herrera was arrested by unknown police officers. A grand jury indicted him and he was arraigned for third degree criminal sale of a controlled substance and third degree criminal possession of a controlled substance. On March 29, 2018, Herrera was acquitted by jury due to false testimony and he was exonerated of any criminal liability.

Even though no contraband was found, plaintiff was arrested. Handcuffs were placed on him too tightly. The officers falsely claimed that plaintiff had illegally sold marijuana in order to justify the arrest. Criminal prosecution was initiated but all charges were dismissed on September 5, 2018.
