Description: Plaintiff was standing outside his residence and smoking a cigarette when he was approached by two officers who pulled up the curb. The officers stated that they smelled marijuana and the plaintiff responded that he didn't have any on him. Plaintiff explained that any marijuana cigarettes found on the sidewalk were probably from the night before, where people had been celebrating the 4th of July. Plaintiff was then told he was being issued a summons, and he asked the officers if he could go get his bike and his backpack, that were unattended on the sidewalk at 15 Quincy Street.
