Description: On April 22, 2012, Plaintiff Carlos Otero was working the overnight shift at a bodega. His brother Daniel Otero was also present. They witnessed a dispute outside the store in which one person was shot. Plaintiffs sheltered the injured man in their store and called 911. After officers arrived, they questioned both Plaintiffs intensely because although they were not suspects they provided vague descriptions of the shooter. Unsatisfied, officers grabbed Plaintiff Carlos Otero and pushed him against a wall. When Plaintiff Daniel Otero objected, officers threw him to the ground and began kicking and striking him.
