Description: On or about December 8, 2019, Plaintiff Russell Baker was a passenger in a vehicle when several New York City Police Officers, including Defendant Police Officers Gallante, Laborde, Natal, Degnan, and Sergeant Ghibaudi, and NYPD Defendants John & Jane Doe 1 through 10 (“DOE Defendants”), stopped the vehicle without any legal justification. Defendants ordered all occupants out of the vehicle and proceeded to search them and the vehicle. Defendants recovered no contraband from Plaintiff. DOs forced Plaintiff to take off his clothes stand against his wall in just his boxers. After an extensive search of apt, DOs tightly handcuffed Plaintiff, took to 32nd Precinct, charged with 140.15(1) trespassing by DO Waring, which was later dismissed.
