Description: On January 3, 2017, Plaintiff’s decedent, James Owens, was at his residence at 967 East 99th Street, Brooklyn, New York. Decendent's sister called to the 911 system of the City of New York, regarding an emotionally disturbed individual at 967 99th Street, in the County of Kings, City and State of New York. A 911 call was made by his sister, requesting assistance with an emotionally disturbed individual (Decendent Plaintiff) In response, Police Officer Patrick Gourlay and Police Officer Kurt Fitzcharles arrived at the scene. Both officers were neither assigned to the Emergency Services Unit nor properly trained to handle situations involving emotionally disturbed persons, as required by NYPD protocols. Upon a...
