Description: On December 20, 2016, Plaintiff and four other individuals were approached by P.O. Verdesoto, Forrester and Vincenzo Dimartino. As this was happening, another member of the group removed what appeared to be a firearm from his jacket and threw said firearm over a fence. He then proceeded to take off running at full speed. The officers were unable to catch him. However, P.O. Verdesoto falsely claimed, and P.O. Verdesoto, Forrester falsely testified, that the individual who tossed the firearm was Plaintiff, when in fact he was well aware that Plaintiff was actually one of the other four in the group, which caused Plaintiff to be arrested and criminally charged. Plaintiff was acquitted on trial.
