Description: On November 12, 2020, Defendant Ayala and the unnamed Defendants unlawfully arrested the Plaintiff, and placed tight handcuffs on him. At no stage did the Defendants inform the Plaintiff of charges. Plaintiff did not resist arrest and was booked at the Precinct. During the booking process, the Defendants made misleading statements to the Prosecution. The Plaintiff was charged with Larceny and placed in Rikers as he was unable to afford bail. During the time at Rikers the Plaintiff suffered several assaults. After approximately 45 days the Plaintiff was released and after a series of court appearances, the matter was dismissed and sealed.

Description: On October 16. 2019, while the plaintiff, a Hispanic male, was lawfully present on a street, defendant police officers Edwin Ayala, and John or Jane Doe, stopped and violently searched him without any justification, based on biased profiling. Despite the plaintiff not having committed any crime, the defendants arrested and tightly handcuffed him, despite his request to loosen the restraints. The plaintiff was then taken to the precinct and subjected to malicious prosecution. However, all charges against the plaintiff were dismissed in his favor.
