Description: On February 3, 2019, at approximately 4:30 a.m., Osiris Bernal was lawfully present in the vicinity of Wheeler Avenue and Westchester Avenue in the Bronx when he was approached by NYPD officers, including Officer Hassan Aftab and other unidentified officers. The officers allegedly stopped, searched, and arrested Bernal without probable cause or legal justification. Bernal was handcuffed, subjected to excessive force, and strip-searched while in custody. He was falsely charged with a crime, detained for over 24 hours, and required to make numerous court appearances before the charges were dismissed. As a result of these actions, Bernal claims to have suffered physical and emotional injuries.
