On September 17, 2018, plaintiff Polanco was stopped, seized and searched, battered and assaulted, detained and arrested by the defendants, with their outstretched hands suddenly and violently grabbing him about his person. The defendants then accused plaintiff Polanco of a criminal offense. They searched his person and recovered no contraband and proceeded to violently contort plaintiff Polanco's arms behind his back so that they could apply metal handcuffs, disregarding plaintiff Polanco's complaints that the cuffs were placed on too tightly causing him significant discomfort and pain. Description: The Defendant NYPD Officers initiated a stop to the vehicle that the Plaintiff was riding in. When the Plaintiff began video recording from his phone, one of the Defendant-Officers pulled the Plaintiff out and begin choking him, pushed him onto the vehicle and placed him in tight handcuffs causing pain and numbness. The Defendant-Officers took his phone and manipulated it to appear as if he was deleting the video. The Defendant-Officers also verbally abused the Plaintiff. The Plaintiff was charged with Obstructing Governmental Administration in the Second Degree and Disorderly Conduct. The charges were eventually dismissed.
