Description: On July 14, 2016, at approximately 2:30am, Plaintiffs Rebecca Edelstein and Jancairo Andujar were sitting in Edelstein's vehicle parked in front of a bodega near 509 51st Street in Brooklyn, NY when they were stopped without probable cause by Defendant NYPD officers DANIEL A. MARTIN (Shield 16213), PEDRO RODRIGUEZ (Shield 28987), and DENNIS HOE (Shield 3915). After Plaintiffs were ordered out of the vehicle and Andujar was immediately placed in handcuffs, the officers conducted a warrantless search of the vehicle, which included a search of Edelstein's closed school bag where the officers allegedly found a police placard. Description: On August 23, 2015, at approximately 1:00 a.m., in the vicinity of 56th Street and 4th Avenue, Brooklyn, NY, defendants PO Hoe and John Does without legal justification or excuse unlawfully arrested plaintiff. Plaintiff was outside talking on the phone when the police approached, grabbed, punched, and handcuffed plaintiff and threw him to the ground. As a result, the plaintiff had his face, wrist, back, hip, knee and shoulder injured. While Plaintiff was in the custody of the defendants at the precinct, Defendants prepared and filed false paperwork against Plaintiff with the DA. All criminal charges were dismissed in Plaintiffs’ favor on November 12, 2015.
