Description: On August 23, 2016, plaintiff was involved in a dispute with the owner/employee of a Fruit and Vegetable store and called 911 for assistance. Defendant NYPD officers Bautista and Conesto arrived in a patrol car, whereupon they were met by plaintiff who attempted to explain the altercation. Instead of listening to him, they entered the store, and, when they came out, arrested him for shoplifting. In the course of the arrest, they assaulted and battered him with excessive force leading to serious injury, and double clicked his handcuffs, causing injury to his wrists.
