Description: On November 25, 2018, plaintiff was lawfully present in the street when defendant POs Bautista and John and/or Jane Doe 1-10, without an arrest warrant, probable cause or reasonable suspicion, stopped, searched and ultimately arrested plaintiff. Defendant POs then knowingly provided inaccurate facts to the District Attorney's Office to cause plaintiff to be prosecuted for crimes he did not commit in retaliation for a lawsuit brought by plaintiff against one of the defendant POs.

Complaint
Description: On August 23, 2016, plaintiff was involved in a dispute with the owner/employee of a Fruit and Vegetable store and called 911 for assistance. Defendant NYPD officers Bautista and Conesto arrived in a patrol car, whereupon they were met by plaintiff who attempted to explain the altercation. Instead of listening to him, they entered the store, and, when they came out, arrested him for shoplifting. In the course of the arrest, they assaulted and battered him with excessive force leading to serious injury, and double clicked his handcuffs, causing injury to his wrists. As a result, plaintiff was held for several hours, whereupon he was given a Desk Appearance Ticket with a return date of November 11, 2016. ...
