Description: On March 11, 2013 the plaintiff was in a verbal dispute with someone when the other individual pulled out a firearm and shot the plaintiff in the calf. On November 12, 2014 an unidentified eyewitness participated in a confirmatory identification procedure and allegedly identified the plaintiff as the perpetrator. On November 13, 2014 the plaintiff was arrested and taken to the 113th Precinct. He was charged with Attempted Murder in the Second Degree, Attempted Assault in the First Degree, 2 counts of Criminal Possession of a weapon in the Second Degree and Assault in the Second Degree. The plaintiff was detained at Riker's Island for 95 days before all charges were dismissed and sealed.

Description: On October 20, 2013, the Plaintiff, a retired Corrections Officer, witnessed a young man viciously attacking a young woman on the street. When the young man noticed that the Plaintiff was observing the assault, the young man threatened the Plaintiff. The young man then told his friends that the Plaintiff "needed to mind his own business" or words to that effect. The young man and his friends swarmed the Plaintiff and threatened to shoot him. One of the assailants showed the Plaintiff a gun before fumbling it into his pants. The Plaintiff shot at and grazed the young man with a bullet. The plaintiff then called 911 and reported the shooting.
