Description: On or about September 18, 2022, the New York City Police Department decided to set up traffic enforcement operations at the intersection of 3rd Avenue and 149th Street in the Bronx. At some point in time, defendant Officers Rivera and JAMES BORTOLOTTI stopped an individual riding an Ebike. Officer Rivera and/or Bortolotti engaged in a heated confrontation with the rider of the E-bike. Officer Bortolotti removed himself from the confrontation with an Ebiker, broke out his baton, and relieved his frustration on an ATV driver by hitting him with a baton.
