Description: On January 4, 2018, plaintiff was walking from his home to a deli in his neighborhood. He was approached by a police vehicle, and officers exited the vehicle and asked plaintiff where he lived. While one officer questioned plaintiff, another officer produced a cigarette butt, which defendants claimed contained a controlled substance. Video footage clearly shows that plaintiff did not possess the cigarette butt. Plaintiff was then asked if he had any weapons on him, which he did not. Plaintiff was then searched, handcuffed, and placed in the back of a police vehicle without reasonable cause. Plaintiff told defendant officers that her friend was not trespassing but was invited to her house. Defendant officers then recognized plaintiff as one of the individuals taking films of Eric Garner's death, and started to assault plaintiff, which resulted in hospitalization. Plaintiff was charged with several misdemeanors and the outcome is unknown.
