Description: On September 1, 2012, at or about 2:30 a.m. Jarmel Jowers was lawfully present inside a residential apartment as an invited guest at a party. Various members of the NYPD arrived and spoke with the tenant. Shortly thereafter, the officers, including Charles Minch, John Portalatin and Nicholas Marciano, entered the apartment where the party was taking place and demanded that everyone leave. Mr. Jowers was outside when an officer approached him and demanded that he be searched. He complied and permitted the search, even though there was no lawful basis for the search.
