Description: On April 5, 2013 Plaintiff was taking his prescription medication on Eighth Avenue when he was stopped by POs and searched. Plaintiff cooperated and was let go. However, a few hours later PO Francis Zito and another stopped and frisked Plaintiff again. When Plaintiff asked what was wrong POs punched, beat, assaulted, and battered Plaintiff without legal justification. Plaintiff was also kicked while he was on the ground, then handcuffed and left on the ground for an unreasonably long period of time. Plaintiff was then taken to the 28th Precinct, given a ticket, then was released. Plaintiff was physically injured and otherwise damaged as a result of this incident.
