Description: On September 5, 2022, at around 10 p.m., Plaintiff was riding his motorcycle in a safe and orderly manner with a female friend on the seat behind him, together with a group of fellow riders, along Eastern Parkway in Brooklyn. Suddenly, a group of NYPD officers ambushed the motorcycle drivers and passengers, knocking them off their vehicles, yelling at them, dragging them, and handcuffing some of them, including Plaintiff. Officer Kelly exited the vehicle pointed and said "stay down." Officer Kelly then handcuffed Mr. Bey without reading his rights and conducted a search without Mr. Bey's consent. Mr. Bey was charged with at least criminal possession of a firearm in the second degree, criminal possession of a weapon in the fourth degree, and reckless driving.
