Description: On July 13, 2010, Defendant Police Officers were preparing to execute a search warrant on Plaintiff’s apartment. Through the use of video surveillance equipment, Plaintiff saw a person in the hallway outside of his apartment and went outside with a gun in his hand. Unbeknownst to Plaintiff, this person was an NYPD detective in plain clothes who fired his service pistol multiple times in Plaintiff’s direction, presumably in response to seeing the gun. Immediately after the shots were fired, Defendant Police Officers entered Plaintiff’s apartment to execute the search warrant.
