Description: On or about October 10, 2011, Plaintiff was driving a taxicab and stopped the cab to allow the passenger out. When the Plaintiff stopped the vehicle, an officer, believed to be defendant Kraus, banged on the taxicab roof and ordered the Plaintiff to speed up. The Plaintiff accelerated. At the next intersection, the Plaintiff was stopped by members of the NYPD who ordered him out of the cab, handcuffed him, and arrested him.
Defendant Lamur was the arresting officer. Lamur’s complaint alleged that the Plaintiff drove away while half of defendant Kraus’s body was still in the taxi and the other half was hanging out of the taxi and that Kraus subsequently fell and suffered injuries. He alleged that the Plaintiff...
