Description: On October 12, 2022, Plaintiff was lawfully on his bike in Queens when a group of POs, including PO Martinez, approached him and advised that he had to leave the area because he was smoking. Plaintiff did not leave, explaining to the POs that he was not smoking--he was waiting for his partner to leave work. The POs left, then returned some minutes later, demanding Plaintiff's ID and asking what was in his bag. Plaintiff asked why they needed his ID when he was not doing anything wrong. Four POs surrounded Plaintiff, continually demanding his ID. One of the POs suddenly said something to the effect of "let's get him," and one of the POs grabbed Plaintiff's arm from behind. The POs then forcibly subdued Plaintiff...
