Description: Allegedly, a suspect who was arrested swore at the police officers and the police officers, including PO Bercan slammed the suspect into the wall. PO Bercan Punched the witness in the face, fracturing his jaw. FACTS: At the aforesaid time and place, plaintiff was accosted by several members of the New York City Police Department. Thereafter, Mr. Lewis was handcuffed and placed under arrest by defendants. While being escorted outside of the apartment, Mr. Lewis uttered certain expletives towards the police officers. Upon hearing these remarks, defendant officers then slammed Mr. Nixon into an adjacent wall. Thereafter, P.O. Paolo Bercan punched Mr. Nixon in his face.
