Description: On August 19, 2013, plaintiff was walking when defendant officers Florencio Arquer, Peter Fiorillio, Brant Martinez, Boris Durets, and others told plaintiff they saw him toss a gun. Defendant officers also claimed they found bullets in plaintiff's pockets. Plaintiff had not tossed a gun or had bullets in his pocket. Plaintiff was thrown to the ground, placed in handcuffs, and had a handgun pointed in his face. Plaintiff was put in a police vehicle and taken to the precinct. Defendant officers falsely told the DA's office that they observed plaintiff in possession of firearms. From the precinct, plaintiff was taken for booking and he was subsequently arraigned in court.
