Description: On July 28, 2020, Defendants, including EDWARD MENDEZ and other unknown police officer assaulted and arrested Plaintiff without justification or probable cause. They used excessive force, caused damages to his bike, confiscated his bag and transported him to a precinct where he was fingerprinted, photographed, and placed in a cell where he remained in custody for hours. Upon release, officers did not return Plaintiff's phone and car keys to him. The DAT issued to Plaintiff was dismissed before the court date.

Description: On or about April 23, 2012, Tate Cavell (plaintiff) was lawfully sat in his vehicle
when Police Officer Edward Mendez, Police Officer John Wilinski (defendants) approached and requested he step out with raised hands then accused him of unlawfully possessing a gun without any probable cause. Defendants used excessive force and Plaintiff was handcuffed, arrested and detained overnight despite no firearm being present. The case was maliciously prosecuted but ultimately dismissed.
The City of NY and NYPD are responsible for their negligent hiring, trianing and supervision.
