Description: On April 20, 2012, Plaintiff was lawfully present in the lobby of her apartment building when she noticed an individual sitting on the stoop leading to the front door. The individual had earlier called 911 and falsely reported that Plaintiff violated an order of protection. Defendant officer Penaranda responded to the complaint and made no arrest at that time. Upon seeing the individual again, Plaintiff called 911 and asked an officer to come to the scene to ensure a second false complaint was not made against her.
