Description: On December 23, 2022, NYPD Officers Obieka W. Marshall and Giovanni Garcia (defendants) responded to a 911 call reporting a verbal argument between the Patrick Smith (plaintiff) and his partner. Despite no allegations of violence or illegal activity, the defendants entered the plaintiff’s apartment, questioned both parties, and confirmed he had committed no crime. However, they refused to leave unless he accompanied them. Under pressure, the plaintiff left voluntarily but was then ordered into an ambulance without cause. When he declined and attempted to walk away, the defendants forcibly shoved him into a fence and began assaulting him.

Description: On March 18, 2016, NYPD officers—including Patrick Coriell, Kamala Roper, Diana Lopez, Elizabeth Medina, and Zenobia Copeland—arrested Plaintiff on the complaint of another civilian. The officers handcuffed Plaintiff, then pushed her on to the sidewalk, causing injuries to both her knees. Plaintiff did not receive medical attention. She was instead taken into police custody and forced to walk on her injuries knees. Eventually Plaintiff was taken to a hospital for emergency room treatment for her knees. Upon release, Plaintiff was placed in leg shackles by NYPD officers—including Williams Jones, David Mancuso, and Sergeant Joseph Mule—which caused pain on top of the existing injuries.
