Description: On March 10, 2012, Plaintiff was driving six small children to a birthday party when Defendant Officers Luparello, Lago, Winters, Paiz, Calderone and Ramirez used their vehicles to surround his SUV. Defendants approached with guns drawn and instructed Plaintiff to get out. As Plaintiff exited he was stuck in the face, thrown to the ground and violently and repeatedly kicked, alarming the children. After the children were taken to the precinct, the officers illegally searched without consent Plaintiff and his car, but found no contraband.
