Description: On February 26, 2012, in the Grand Army Plaza Subway Station (2/3 Line), Brooklyn, Donrick was traveling on the subway and fell asleep and missed his stop. Donrick woke up when he noticed the subway was not moving. The defendant uniformed officers, were holding the subway car doors open, and signaled to Donrick to come to them. Donrick walked to them. The police told Donrick to leave the subway car. Donrick left the subway car. Officers asked Donrick for his ID and if he had any warrants. Donrick produced his identification and told them that he had no warrants. Donrick sat on a bench and reached into his pocket for his phone.
