Description: On October 1, 2011, the NYPD unlawfully entered into the residence of plaintiff Manuel Hernandez without consent, a warrant, probable cause, or reasonable suspicion that plaintiff had committed a crime. After entering the premises by breaking down the door, one NYPD officer came straight at plaintiff and punched him in the face and threw him to the floor. The same officer kicked plaintiff, grabbed plaintiff by the genitals, handcuffed plaintiff, and took money from plaintiff that he did not voucher. Another officer laughed at plaintiff and kicked plaintiff. Plaintiff was physically injured as a result of this unprovoked attack, including facial fractures.
