Description: On April 17, 2017, around 1:00 P.M., in the vicinity of 2745 Schley Ave, Bronx, Plaintiff Jose A. Lopez was locked out of his apartment. While Plaintiff's neighbor attempted to access the apartment by taking off the lock. Plaintiff watched and at no time did Plaintiff attempt to take off or damage the door. Plaintiff was stopped, handcuffed, and arrested. Plaintiff did not engage in any illegal activity. Plaintiff was transported to a precinct and nothing unlawful was recovered. Between April 18, 2017, and October 24, 2018, Plaintiff made numerous appearances until the matter was dismissed in Plaintiff's favor. Plaintiff was caused to suffer physical and severe emotional distress.

At this time defendant NYPD officers unlawfully stopped and seized the plaintiff accusing her of possessing drugs. At no time did Ms. Posas possess any drugs, contraband, illegal paraphernalia, or commit any crime.
