Plaintiff had come to a hospital where his son had been admitted as a gunshot victim. Plaintiff was not an immediate threat to himself before being tased, nor was he actively resisting custody. Description: On June 5, 2015, Officers Kristen Swinkunas, Jayson Basnight, and Daniel Miller approached the Plaintiff while he was sitting inside his vehicle waiting to pick up his son and asked for his registration and license.
