Description: On September 2, 2020, plaintiff was tased by defendant Baltzer while plaintiff was engaged in a conversation with police officers about moving a vehicle belonging to this family out of a certain street. Plaintiff had come to a hospital where his son had been admitted as a gunshot victim. Plaintiff was not an immediate threat to himself before being tased, nor was he actively resisting custody. The discharge of the taser knocked the plaintiff to the ground forcefully. He struck his wrist and sustained scrapes and bruises. The plaintiff was handcuffed on the ground. Description: On June 5, 2015, Officers Kristen Swinkunas, Jayson Basnight, and Daniel Miller approached the Plaintiff while he was sitting inside his vehicle waiting to pick up his son and asked for his registration and license. The Plaintiff cooperated with the officers and provided the requested documentation. In response, the officers instructed the Plaintiff to step out of his car with his hands raised. The Plaintiff was then questioned about the sale of his car and was accused of criminal possession of a forged instrument without any legal cause.
