Description: On March 3, 2020, Plaintiff was lawfully traveling on the C-Line MTA Subway Train near the MTA Franklin Street Subway Station in Brooklyn when Defendant officers unlawfully stopped, questioned, frisked, and arrested him without probable cause. Plaintiff was moving to a safer part of the train to avoid a threatening passenger when Defendant officers, in plain clothes, surrounded, grabbed, and forcibly removed him from the train. During the arrest, Plaintiff was pushed, pulled, pepper sprayed, and excessively handcuffed, causing physical injuries. Despite complying, Plaintiff was repeatedly pepper sprayed even after being restrained.
