Complaint
Description: On May 23, 2018, at approximately 3:30 p.m., in the vicinity of Audubon Avenue in New York County, without just cause or provocation, Defendant Police officers Fernando Rodrigues (shield # 27943), Patrick Duffy (shield # 16912) and John Bonhomme (shield # 00633), handcuffed Plaintiff and intentionally and falsely accused Plaintiff Ermiluis Pichardo, of having committed the crime of Criminal Possession of a Weapon in the Third Degree. On May 24, 2018, a criminal complaint was issued at the directive of the Defendants and a criminal action against Plaintiff commenced. The criminal matter was terminated in favor of Plaintiff on November 19, 2018.

Complaint
Description: On March 8, 2017, police officer Patrick Duffy and another unidentified police officer searched plaintiff, found a small pocket knife, and ordered hm to put his hands behind his back. Plaintiff ran, but ultimately stopped, knelt down, and put his hands up. The officers nevertheless tasered plaintiff and handcuffed him. One officer hit plaintiff in the head. The officers then tasered plaintiff a second time, while he was handcuffed. Officer Duffy signed a criminal complaint falsely stating that plaintiff was in possession of a gravity knife and that he refused to surrender after he stopped running. The charges against plaintiff were ultimately dismissed.
