Description: On March 29, 2015, Plaintiff was informed that a friend who he let drive his vehicle had been in an incident in Kings County, New York. Plaintiff arrived to find his vehicle facing the wrong direction in the street with the front passenger wheel removed. No one was injured and no property was damaged in the incident. The friend who was driving left the scene while Plaintiff waited for a tow truck. NYPD Officers—including Sergeant Justin Simms, PO Genine O’Neill, and PO Perceval—arrived, asked Plaintiff questions about the incident, and ultimately arrested Plaintiff. Description: On July 21, 2012, at around 4am plaintiffs were in a Honda motor vehicle while driving on West 39th St, New York, NY. Plaintiffs were heading towards the Lincoln Tunnel to return home to New Jersey. Defendant officers commanded plaintiff Augusto Perez to stop his vehicle. One of the officers told the plaintiff he was being stopped because he was not wearing a seatbelt. Plaintiff had in fact been wearing one.
