Description: On May 6, 2015 plaintiff and plaintiff's wife were verbally threatened by an assailant who had harassed them repeatedly in the past due to the plaintiff being a trans man. Assailant's conduct was so threatening that one of plaintiff's neighbors came out of his apartment with a baseball bat. Several people called 911 and the NYPD dispatched defendant officers Ureiba and Garcia. When the police officers arrived they initially directed the assailant to step back, but upon learning of Plaintiff's gender identity their demeanor changed.
