Description: Plaintiff got into a physical altercation with her roommates when somebody shot a gun and police responded to the scene after hearing reports of a gunshot. Police then arrested Plaintiff, brought her to the 113th Precinct, and charged her with two counts of Criminal Possession of a Weapon in the Second Degree (PL ßß265.03[1][b] and [3]), Criminal Possession of a Weapon in the Third Degree (PL ß 265.02[1]), Reckless Endangerment in the First Degree (PL ß 120.25), and Unlawful Possession of Pistol Ammunition (AC ß 10-131[1][3]). Charges were later dismissed.

Description: On August 3, 2013, while plaintiff was walking on the sidewalk, P.O. Rizzo approached him and pushed him. When plaintiff asked why Rizzo had pushed him, Rizzo grabbed plaintiff's arms to arrest him. Four other officers approached and assisted Rizzo in the arrest. O'Connor kneed plaintiff in the testicles, causing plaintiff to fall to the ground. The officers placed knees on plaintiff's body and one officer placed a knee on plaintiff's neck, restricting his breathing. The officers then handcuffed him and took him to a precinct. At the precinct, plaintiff's request for medical attention was ignored. Plaintiff was imprisoned until August 5 on which date plaintiff was arraigned on false charges. The officers manufa...
