Description: On March 01, 2023, Edward Ortiz was lawfully in the area of 920 Avenue St. John in the Bronx. Around 11:00 p.m., Defendant Officers Roman, Zafar, Paulino, Doe and Roe, approached Mr. Ortiz without an arrest warrant, probable cause, or any legal justification, and stopped, searched, grabbed, assaulted, battered, and detained him in an excessive manner. Mr. Ortiz was arraigned after his arrest and maliciously prosecuted with committing a crime. Ultimately, Mr. Ortiz remained incarcerated for over twenty-four hours and was required to make numerous court appearances before all charges against him were terminated favorably.

Description: On August 11, 2019, plaintiff Michael Ortiz was lawfully in the vicinity of Virginia Ave and Ellis Ave when Plaintiff was verbally and physically assaulted by an unknown person in a convenience store. Plaintiff was then physically assaulted by Police Officers upon their arrival. Plaintiff was taken to a precinct and then Jacobi Hospital to be treated for injuries to his shoulders, head, and lower back. Plaintiff was then taken to central booking and was incarcerated for about 24 hours. Plaintiff was released upon accepting an Adjournment in Contemplation of Dismissal. All charged against Plaintiff were dismissed on February 10, 2020.
