Toshia spoke with Badillo, who refused to give information she requested, saying “I’m not going to do what you want me to do;” and “Not on your time.” An ambulance was slowly coming down the street. Description: On March 22, 2017, while lawfully driving around Cypress Avenue and East 138th Street in Bronx, NY, the plaintiff was unlawfully stopped, seized, arrested, and detained by the defendants, including Edward Gaston and John Does 1-2, without legal justification. After the arrest, the plaintiff was taken to a local precinct where he was prohibited from using the restroom for approximately 4-6 hours, causing him to be taken to Lincoln Hospital.
