Description: Oh February 20, 2023, Plaintiff was at a street corner playing with his friend's dog when Defendant Detective Michael Simmonds was driving and struck the dog with his car, which became trapped under the car. Plaintiff assisted in freeing the dog but Defendant Simmonds was intoxicated, the smell of alcohol was prevalent on his breath, and became enraged with Plaintiff. Defendant Simmonds then put his hand on his gun and trapped Plaintiff against a window and began choking him. Defendant Officers Javier Colon, Cesia Herrera, and Navdeep Kamboj arrived and pulled Defendant Simmonds off Plaintiff.
