Description: On October 31, 2020, Plaintiff was inside a leased commercial space when police officers knocked on the door of the leased commercial space and asked to speak to the lessor of the commercial space. Plaintiff told the officers that the lessor was not present. The two landlords of the commercial space told the officers that Plaintiff was lawfully present inside of the leased commercial space and that he worked for the lessor. The officers spoke to the lessor by phone and learned that he was not inside the leased commercial space or even inside the building. Description: On December 31, 2011, Plaintiff was peaceably assembled at Zuccotti Park on December 31, 2011, with other citizens as part of the Occupy Wall Street movement. A large number of NYPD officers were present, and NYPD initiated physical confrontations with citizens, using metal barricades as a weapon/battering ram to push the crowd. Plaintiff was knocked down. Officer Vega and an unknown officer deployed pepper spray at a group of which Plaintiff was a part of. While blinded by pepper spray, Plaintiff was pushed and fell, breaking his hand in a way that required surgery. As a result, Plaintiff was unable to perform basic life tasks during his recovery and Plaintiff later lost his job.
