Description: On July 8, 2017, at the intersection of Richmond Terrace and Union Avenue in Richmond County, NY, Plaintiff was driving with a passenger named Justin Rodriguez and was pulled over for possibly having windows that had too dark of a tint. The officer asked both Plaintiff and the passenger to produce identification. While they told Plaintiff that they did not have a tool to check the tint and he was therefore free to go, they ordered the passenger, Justin Rodriguez, out of the car because they had a warrant out for him. Rodriguez refused to get out of the car, insisting that there was no warrant. As a result, Officer Ryan Smith and three other officers forcibly dragged both Plaintiff and Rodriguez out of the car a...
