Description: On October 30, 2021 plaintiff James Rhodes was playing his Saxophone in a reasonable manner on a side walk when Police Officer Alpsoy approached plaintiff and instructed plaintiff stop playing and leave the area. Rhodes asserted his constitutional right to play his saxophone in a reasonable manner and refused to stop or leave. Eventually SGT. Burgos arrived and instructed plaintiff to leave and Rhodes reasserted his constitutional right. After, P.O. John Doe attacked Rhodes with a taser, even though Rhodes posed no threat to anyone, and SGT. Burgos, P.O. Alpsoy, and P.O. Jane Doe did not stop their colleague from the unlawful use of force. P.O.
