Description: On September 3, 2014, at Rockaway Beach, Queens, NY, Plaintiff was spending the day with her family at the beach. Plaintiff and her cousin took a walk on the beach. They shared a cigarette. They did not want to smoke in from of her cousin's daughter. By the time they threw the cigarette out, four officers approached and accused Plaintiff and her cousin of smoking marijuana. Officers arrested Plaintiff and her cousin and charged them with obstruction of governmental administration for swallowing the joint. Plaintiff tried to show the officer where in the sand the cigarette butt was but could not find it. Officers arrested Plaintiff in her bathing suit and did not allow her to change clothes.
