Plaintiff incurred injuries about his head, neck, back, body, and limbs. Plaintiff was taken to a precinct, strip searched, arraigned, and maliciously prosecuted with committing a crime. Plaintiff was incarcerated for over 24 hours. All charges against Plaintiff were ultimately terminated in his favor.

Defendant was tightly handcuffed and arrested. Defendant officers provided false affidavits and police reports, and conveyed false information to prosecutors. On January 24, 2020, the charges against plaintiff were dismissed (plaintiff was in custody for approximately 210 days) and defendant officers were found to have violated plaintiff's constitutional rights.

Description: On or about December 21, 2013, Defendants Police Officer T. Pando and John/Jane Does 1-20 wrongfully touched, grabbed, searched, handcuffed, seized, subjected to excessive force, stripsearched, and arrested Plaintiff. Plaintiff was held until December 22, 2013 at approximately 8:30PM, just over 24 hours after the initial incident. Plaintiff was not read his Miranda Rights nor allowed access to a phone call or a lawyer. Plaintiff was arraigned on April 27, 2014 as a result of a complaint filed by Defendants Police Officer T. Pando and John/Jane Does 1-20 who purposefully prosecuted Plaintiff. Plaintiff suffered humiliation, pain, and great distress of mind and body including physical and emotional injuries.
