Description: On August 25, 2017, the plaintiff, the operator of a livery vehicle, stopped his vehicle on the side of the street in order to pick-up a passenger-for-hire. Shortly after stopping, NYPD vehicles arrived on the street, including one NYPD vehicle which blocked in the plaintiff's vehicle. NYPD officers appeared to be clearing the sidewalk, however, no NYPD officer requested plaintiff move or leave his vehicle. Plaintiff proceeded to open his front driver's side door to ask his passenger to enter the vehicle. At that time defendant-NYPD Sergeant Phillip Orlando ordered officers present to arrest any person who remained on his sidewalk.
