Description: On July 6, 2013, plaintiff was exiting a motor vehicle when he was approached by defendants and informed that he had committed a traffic violation. Plaintiff informed defendants that he was not the driver of the vehicle and that he was waiting for his girlfriend. Defendant Foy ordered plaintiff back into the vehicle. Defendants then searched the vehicle and found a small quantity of marijuana. Plaintiff was arrested and transported to a nearby precinct and released after 3 hours in custody. The charges brought against plaintiff were ultimately dismissed.
