Description: On April 23, 2014, plaintiff was exiting the train when he saw a woman crying and police officers restraining a man nearby. Sgt. Jose Luis Deluna approached the young woman and ordered her to be quiet or be arrested. The young woman looked at plaintiff, who was heading toward the exit. Plaintiff looked back at the young woman and said, "Hey," and Sgt. Deluna immediately grabbed one of plaintiff's hands. Sgt. Deluna threatened plaintiff and gave him to the count of three to walk away. When Sgt. Deluna reached the number three, plaintiff had not left the area. Sgt.
